Laivy Hart (laivyhart.com, "the Site," "we," "us") is a music platform for original songs. By creating an account, uploading content, or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

Accounts. You must be at least 13 years old to hold an account and at least 18 years old to upload or submit content. You are responsible for your account and for everything done through it. Provide accurate information and keep your sign-in secure. We may suspend, restrict, or delete any account at any time, with or without notice, for any reason, including inactivity, suspected misuse, or violation of these Terms.

Your content and the license you grant. You keep ownership of the songs, recordings, lyrics, artwork, and other material you upload ("Your Content"). By submitting Your Content, you grant Laivy Hart a non-exclusive, worldwide, royalty-free, sublicensable (to our service providers and hosting partners), transferable license to host, store, reproduce, encode, compress, stream, display, perform, distribute, create excerpts and previews of, and otherwise use Your Content on and in connection with the Site and its promotion, in any medium now known or later developed, for as long as Your Content remains on the Site and for a reasonable period afterward to the extent needed for backups, caches, and copies already distributed. You also grant other users the right to stream and share links to Your Content through the Site's features. You waive any right to be identified as the author beyond the attribution the Site provides, and any right to object to reasonable technical or editorial adjustments (such as formatting, compression, cropping, or the assignment of categories, tags, or channels).

Your promises about Your Content. You represent and warrant that: (a) Your Content is your own original work, or you hold all rights, licenses, consents, and permissions needed to submit it and to grant the license above, including for any samples, melodies, lyrics, artwork, and performances it contains; (b) Your Content does not infringe or misappropriate any copyright, trademark, right of publicity, privacy right, or other right of any person; (c) Your Content does not imitate, impersonate, or falsely suggest the involvement or endorsement of any named artist, living or dead, including through the use of AI tools; (d) any content created wholly or partly with AI tools is disclosed as such where the Site asks, and you hold the rights to submit it; (e) Your Content is not unlawful, defamatory, harassing, hateful, obscene, or otherwise objectionable, and does not contain malware or deceptive material; and (f) you are at least 18 years old.

Review, publication, and removal. Nothing you submit is public until we approve it. We review submissions at our sole discretion and may approve, reject, edit metadata (such as titles, transliterations, categories, tags, channels, and featured placement), or remove any content at any time, with or without notice or reason. Approval is not an endorsement and does not verify your rights. We may remove content in response to a rights complaint or on our own judgment. You may withdraw Your Content from public view through your account; copies may persist in backups and caches for a period.

5. תלונות על זכויות

Rights complaints. If you believe content on the Site infringes your rights, contact hello@laivyhart.com with the URL, a description of the work and the claimed infringement, your contact details, and a statement of good-faith belief. We may remove or disable access to the material and may notify the uploader. Repeat infringers will have their accounts terminated.

6. שיפוי

Indemnity. You will defend, indemnify, and hold harmless Laivy Hart and its owner, affiliates, and service providers from any claim, loss, liability, damage, cost, or expense (including reasonable legal fees) arising from Your Content, your use of the Site, or your breach of these Terms.

No warranty; limitation of liability. The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose, non-infringement, availability, or accuracy. To the fullest extent permitted by law, Laivy Hart is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, lost content, lost profits, or lost opportunities, arising from or related to the Site or Your Content, and our total liability for any claim is limited to the greater of the amount you paid us in the twelve months before the claim (if any) or fifty US dollars.

8. פרטיות

Privacy. We store your email address and sign-in identity to operate your account, the content and metadata you submit, and usage analytics to understand how the Site is used. We do not sell your personal information. We use third-party providers (hosting, storage, email, analytics) who process data on our behalf. You may delete your account from your settings, which removes your public profile and takes your songs off the Site; some data may be retained as required by law or for legitimate business purposes such as backups, records of prior consent, and abuse prevention. 9. התנהלות

Conduct. Do not attempt to circumvent submission limits, review, or security; do not scrape or bulk-download the Site; do not interfere with the Site's operation; do not upload content on behalf of someone else without authority.

10. שינויים וסיום

Changes; termination. We may change these Terms at any time by posting a new version with a new date; continued use after a change is acceptance. We may end or suspend the Site or your access at any time. Sections 2 through 7 survive termination.

11. דין וסמכות שיפוט

Governing law and disputes. These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute will be brought exclusively in the state and federal courts located in New York County, New York, and each party consents to the personal jurisdiction of those courts.

13. הגשת רעיונות לשיר

Idea submissions. If you submit a song idea, you grant Laivy Hart a perpetual, worldwide, royalty-free license to use, adapt, and publish the idea and any words you submit with it, with or without modification. We owe no payment for an idea, are under no obligation to use it, and you have no right to approve or reject the song that may result. Any song Laivy Hart makes from an idea belongs to Laivy Hart, with credit given to you as you chose when submitting, including anonymously if you asked for that. Laivy Hart may create songs on similar themes from any source, including other members' ideas, whether or not related to yours. By submitting an idea, you confirm it is yours to share and that it contains nothing unlawful.
